Abstract
In facing the potential of international trade, Indonesia requires legal certainty in protecting the
existence of intellectual property. The existence of an integrated circuit layout design as a blueprint for
integrated circuits, used in various information technology products, such as computers, cellular telephones, and
communication equipment, has its own characteristics that are not suitable to be placed in the existing
intellectual property law regime, therefore, it needs to be regulated in a special statutory regulation (sui generis).
This research uses a comparative juridical approach research method by applying the statutory approach and the
comparative approach. Indonesia has enacted a law on Layout Design of Integrated Circuits, but this law has
several weaknesses. The weaknesses that exist relate to the completeness and quality of norms and law
enforcement. This weakness is not only from the technical aspect of drafting legislation, but also is rooted in the
legal culture.
